VeryGames SARL reserves the right at any time and without notice to add to, modify or delete the information contained in this notice. This notice does not constitute any contractual or other link between the company and the visitors to the site or their respective assigns.
The User is therefore advised to consult the latest version of the Terms of Use regularly.

Personal information collected:

In France, personal data are protected in particular by Law 78-87 of 6 January 1978, Law 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code, and the European Directive of 24 October 1995. When you use the verygames.net website, the following data are collected: In any event, verygames.net collects personal information relating to the User (name, e-mail address, telephone number) only for purposes of the services offered by the verygames.net website. The User provides this information knowingly, in particular when the User inputs the information himself/herself.
Users of the verygames.net website are therefore informed as to whether the information they provide is required or not.

By proving his/her identity, the User is able to request from VeryGames.net, at the e-mail address webmaster@verygames.net: No personal information about Users of the verygames.net is:Only the buyout of verygames.net or of its rights would make possible the transmission of said information to the buyer, who would in turn be bound by the same obligation regarding keeping and modifying the data vis-à-vis Users of the verygames.net website.

verygames.net is however authorised to do statistical studies and analyses regarding the use and the type of users of the www.verygames.net site, so long as it confirms that these data will remain anonymous.

The verygames.net website and its collection of the personal information of its Users have been declared in advance to the CNIL and registered under receipt number:1479967 v 0.


Cookies:

A «Cookie» allows identification of the User, personalisation of his/her consultation of the verygames.net website, and faster loading of the site’s pages through the recording of a small data file on the User’s computer.
The User acknowledges having been informed of this practice and authorises verygames.net to proceed to it.
In any case, VeryGames.co.uk undertakes never to communicate the content of these cookies to third parties, unless it is legally required to do so.
The User may refuse to accept «Cookies» or configure his/her browser to be notified in advance when «Cookies» are accepted.


Right of withdrawal:

Notwithstanding article L.121-20-2 of the French Consumer Code, the User no longer has the right to withdraw as of the date and time that the service is provided.It is important to note that the VeryGames.co.uk service is implemented instantly after payment, except when payment is by bank transfer.

Notwithstanding article L.121-20-1 of the French Consumer Code, the User has a right to withdraw within seven (7) days if the service has not yet been implemented (in particular when there is a problem with installation of the service, a pre-order, or payment by bank transfer).
This right of withdrawal is exercised by sending a message to the support service at the following address: https://www.verygames.net/ticket and entitles the User to a refund of sums already paid within thirty (30) days after receipt of the notification.

Any withdrawal request that does not comply with the legal deadline or the formalities described in the preceding paragraph will not be accepted.


Refund:

1. Formal requirements of a refund request

A refund request is submitted by ticket in the account of the customer who made the payment.

2. Substantive requirements of a refund request

A refund request must be technically justified.

We thereafter refer to the terms of article 11, section 5, of the ToS:

« VeryGames services are not subject to any fixed-term contract other than the duration already paid for by the customer. To end a rental, the customer should simply not renew it. »

Therefore, if the Customer simply states that he has changed his mind and does not want the service any more, the refund request will be rejected, even for the portion of the subscription period which has not elapsed. The customer has signed for a fixed term, so the service cannot be subject to a refund in money.
However, in this case and exceptionally, we can offer to reimburse the rental in Tokens, for the portion of the subscription period which has not elapsed.
For this operation, 1 € of management fees will be charged to the Customer and deducted from the amount of the refund, regardless of the amount.

4. Consideration of refund

If all the requirements are met, we can, exceptionally, grant a refund in money of the total value of the service if it was not installed or for the portion of the subscription period which has not elapsed.

The refund in money is not possible for the following payment methods:

The payment will be refunded completely in tokens if it was not installed or for the portion of the subscription period which has not elapsed.
1 € of management fees will be charged to the Customer and deducted from the amount of the refund.

The refund in money is possible under certain conditions, for the other payment methods.

Here are the aforementioned conditions:

The refunds of payments made with a bank card or PayPal are only possible once the automatic renewal subscriptions cancelled.
The refunds via PayPal are only possible within 2 months of the payment.
1 € of management fees will be charged to the Customer and deducted from the amount of the refund.


Combating fraud:

1. Anti-fraud check

An individual may have only one VeryGames account. Creating accounts under false identities for the purpose of violating the provisions of the Terms of Sale is prohibited. The use of a VeryGames account to engage in unlawful activities will likewise be considered fraud. Any fraud carries with it termination of the account. Any use of computer script to attempt to create multiple accounts or adversely affect the site is prohibited.

In the event of fraud or suspicion of fraud, VeryGames proceeds to warn, suspend and exclude (temporarily or permanently) the User or Users concerned.
In any case, in the event that an account is closed by VeryGames because of a violation of these Terms of Use, the User will lose his/her rights to the bonus points and to any other promotional offer that may have been granted.
VeryGames also reserves the right to seek return of sums obtained fraudulently, by any legal means.

In the event of fraud or attempted fraud, the personal data concerning the User may be communicated to the legal authorities or to other companies and institutions involved in combating bank fraud. The anti-fraud check was instituted as a result of the growing number of fraudulent transactions.

2. Anti-fraud systems

Each User must provide a valid e-mail address when registering. In order to verify the existence of this e-mail address, an activation e-mail is sent to the address indicated. If the account has not been enabled within seven (7) days, the account is automatically deleted.

Aware that the simple e-mail confirmation system is not enough to combat fraud, and wishing to provide a reliable, quality service, VeryGames may, in addition to the e-mail confirmation, conduct non-systematic and targeted telephone confirmations (Only for France) of orders and payments.

In addition to – or instead of – telephone confirmation (Only for France), VeryGames reserves the right to require proof of identity (copy of the front side of an identification document, proof of residence).VeryGames is authorised by the CNIL for this purpose.
If asked, the User who has made the payment must send to VeryGames within 24 hours the proof demanded by e-mail or letter. If the proof is not received within this 24-hour period, the service will be suspended.

Technical resources may be applied to regulate the number of accounts created from a single IP address in order to limit abuses.
The current limit is as follows: 3 member accounts created per IP address.


Data retention et deletion

VeryGames retains user data for as long as necessary for the purposes described above.

Users may request deletion of their accounts at any time. VeryGames may retain user data after a deletion request due to legal or regulatory requirements or for reasons stated in this policy.

This means that we retain different categories of data for different periods of time depending on the type of data, the category of user to whom the data relates, and the purposes for which we collected the data.

Users may request the deletion of their account at any time by making a written request to customer support, by submitting a ticket (here).

Following an account deletion request, VerGames deletes the user’s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute.

All elements of the verygames.net website, in particular the text, presentations, illustrations, photographs, diagrams and formatting, except public documents and additional specifications, are the exclusive property of VeryGames.co.uk or its partners.
As such, it is prohibited to represent, reproduce, overlap, and partially or completely distribute or redistribute them, pursuant to the provisions of article L. 122-4 of the Intellectual Property Code. Any person doing so without being able to prove prior and express authorisation by the holder of these rights will incur the penalties relating to the crime of infringement established by articles L. 335-2 et seq. of the Intellectual Property Code.
